Data Protection

We adhere to strict guidelines around the safety of your personal information relating to Data Protection. Please see below the copies of all our Privacy Notices. Todmorden High School does not store biometric information for students or staff. Consequently we do not have a policy for this.

Freedom of information requests

For a request to be valid under the Freedom of Information Act it must be in writing. Please use the following template to submit a Freedom of Information request to our school. Any requests can be brought in by hand or emailed to admin@todhigh.co.uk, clearly labelled on the subject line as 'Freedom of Information Request - DATE' with the date added. If you cannot make your request in writing because of a disability or other reason, please contact us directly by telephone on 01706813558. 

When writing your request you must include your real name and an email or postal address.

You do not need to know which law you’re making a request under (eg FOIA, EIR or INSPIRE) or say why you want the information, although this information does make it much easier to respond to. 

We aim to send you the information within 20 working days of receiving your request (taking into accounts period where the school is shut for holidays).

Subject access requests

Subject access requests, also referenced as SARs, are requests for personal data. Anyone who has capacity to understand their data rights can make a SAR.

Provided that an individual has the authority to do so (in writing), they can make a SAR to us on behalf of a third party (their spouse, family member or a friend). As our students are 11-16, due to their age and maturity, we will also seek for consent from them before providing data to a parent. Identification will be required in order to access information. 

Any subject access requests should be made to our GDPR Ambassador via email or verbally. Your request will be acknowledged upon receipt. Your request will be dealt with within one month of receipt. 

Accessing educational records

The Education (Pupil Information) (England) Regulations 2005 (SI 2005/1437) give parents of pupils at Local Education Authority (LEA) maintained schools the right to access their child's educational records.

Schools do, however, have the right to refuse a parent’s request for information in some circumstances; for example, where the information might cause serious harm to the physical or mental health of the pupil or another individual.

The school must make a pupil’s educational record available for inspection or provide a copy of the record within 15 school days of a parent’s written request. The school cannot charge to make the record available for inspection. Any charge for copying the educational record must not exceed the cost of supply.
